The petitioner apprehends his arrest in connection with Complaint Case no. 1716 C/2010 for the offence punishable under Section 498(A) of the Indian Penal Code and /section 3⁄4 of Dowry Prohibition Act.
Soni Devi, the wife of the petitioner, filed a complaint case alleging therein that the petitioner and other in-laws subjected her to all sorts of physical and mental torture for non fulfilment of demand of dowry and also drove out of the house. Learned counsel for the petitioner submits that the complainant is in habit of filing such complaint. Prior to this the complainant also filed a complaint case bearing Complaint
Patna High Court Cr.Misc. No.32798 of 2014 (2) dt.02-02-2015 2/2 Case no. 1387C/2010 in which the petitioner has been enlarged on bail.
Having considered the fact that this is the second complaint petition filed by the wife making similar allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender in the court below, within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui, in Complaint Case No. 1716C/2010, subject to the conditions as laid down u/s 438(2) Cr.P.C.
