2. The petitioners apprehend their arrest in Shankarpur P.S. Case No. 221 of 2024, registered for the offences punishable under Sections 126(2),115(2),117(2), 118(2), 109, 303(2),134,329(3),352, 351(2)(3) and 3(5) of the BNS, 2023.

3. As per F.I.R., on account of land dispute, all the FIR named accused persons, including these petitioners, came at the disputed land and thereafter, started abusing and assaulting informant and his family members. These petitioners are alleged to have assaulted informant's uncle by means of Lathi, Khanti and iron rod.

4. Learned counsel for the petitioners contends that on account of land dispute between the parties, a free fight took place, in which, both sides sustained injury. Case and counter case. Allegation of assault is general and omnibus. A title suit is also pending between the parties, vide Title Suit No. 586 of 2022. Similarly situated three co-accused persons have already been extended the privilege of anticipatory bail by a coordinate Bench of this Court, vide order dated 27.08.2025 passed in Cr.Misc. No. 57363 of 2025.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Madhepura in connection with Shankarpur P.S. Case No. 221 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, (Prabhat Kumar Singh, J) anay U T
