JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Sitamarhi P. S. Case No. 323 of 2019, disclosing offences under Sections 419, 420, 338, 269, 270, 467, 468 and 188 of the IPC.

As per F.I.R. there is allegation against the petitioner, who happens to be the M.B.B.S. Doctor, without having M.S. Decree, he was performing operation.

Submission of the learned counsel for the petitioner is that there is no allegation that has done to his above act and he harmed any person. Petitioner is M.B.B.S. Doctor, as such, he has performing as the Doctor. At best it is the case of negligence and a departmental proceeding may be initiated against him. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.60082 of 2019(3) dt.20-11-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P. S. Case No. 323 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
