2. The petitioner is apprehending his arrest in connection with Complaint Case No. 1901 of 2023 for the offence under Sections 498A and 34 of the I.P.C.
3. As per the prosecution story, the complainant has alleged that her marriage was solemnized with the petitioner on 02.07.2020 according to Muslim rites. After the marriage, complainant started residing in her matrimonial home. Thereafter, it is alleged that the petitioner along with his family members started demanding Rs. 1,00,000/- (One Lakh) in cash and a motorcycle. On refusal, the complainant was subjected to torture variously and ultimately the petitioner has ousted her

4. Learned counsel for the petitioner submits that the petitioner has been falsely been implicated in this case and the complaint case is merely based on false, concocted and cook and bull story. The petitioner is completely innocent and has not committed any of the alleged offence in any manner. There was no demand for any dowry made by the petitioner before or after marriage neither petitioner has subjected the victim to cruelty during her stay in matrimonial house. The complainant (O.P. No. 2) has also filed a maintenance case vide Maintenance Case No. 170 of 2023 which is pending before the Court of learned Principal Judge, Family Court, Gopalganj.
5. Learned APP opposes the prayer for bail.
6. During course of argument, learned counsel for the petitioner further submits that the petitioner is ready to pay Rs. 4,000/-(Four Thousand) per month for the maintenance of his wife, to show his bona fide conduct. The above amount of maintenance will be adjusted in any future order regarding maintenance passed by any competent Court. In this regard, learned counsel also submits that the petitioner is ready to file an affidavit regarding payment of aforesaid amount timely. Keeping in view the aforesaid facts, this Court is inclined to

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Complaint Case No. 1901 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
