The petitioners seek pre-arrest bail in connection with Gamhariya P.S. Case No. 36 of 2019 for the offence alleged under Section 365/34 of the Indian Penal Code. The accusation is that marriage of Usha Devi, daughter of the informant, Most. Anari Devi, was performed before 4-5 years with Sanjeet Yadav of village Piprahi. In the morning of 01.03.2019 her father-in-law, Gajendra Yadav, and brother-in-law, Ranjeet Yadav, gave information to her (informant) about moving of her daughter without giving information from matrimonial house. When the informant along with other reached at Piprahi, matrimonial village of her daughter, then, could not find his daughter. Informant raised suspicion about concealing of his daughter due to grudge. The learned counsel appearing for the petitioners

Patna High Court CR. MISC. No.59998 of 2019(2) dt.23-09-2019 2/2 submits that all the three petitioners are mother-in-law, fatherin-law and sister-in-law of daughter of the informant while daughter of the informant has stated in her statement under Section 164 of the Criminal Procedure Code about forcibly keeping her in straw house tying her hand and after some time she has been thrown near a bridge, but, she has denied about her kidnapping. In fact, due to misunderstanding with her husband, daughter of the informant has made false allegation against the petitioners and others.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Gamhariya P.S. Case No. 36 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Madhepura, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
