The petitioner seeks regular bail in connection with Tandawa P.S. Case No. 04 of 2008 for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code. The allegation is regarding the deceased having died in his house and it has been alleged that the accused persons had conspired together and killed the deceased.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and is languishing in custody since 05.07.2019. The learned counsel for the petitioner has further submitted that the mother of the deceased has been examined under Section 164 Cr. P.C. by the learned Magistrate and she has

No.57791 of 2019(2) dt.01-10-2019 2/2 categorically stated that when the deceased did not respond from inside the room, with the help of other people, the door of the room was broken and the deceased was found hanging from the ceiling, hence it is stated that the death took place by hanging. It is further submitted that by an order dated 09.09.2019 passed in Cr. Misc. No. 54161 of 2019, the main accused person has been granted bail by a co-ordinate Bench of this Court.
Considering the facts and circumstances of the case and also noting the fact that the main accused person has already been granted bail by a co-ordinate Bench of this Court, I deem it fit and proper to enlarge the petitioner, above named, on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Tandawa P.S. Case No. 04 of 2008.
