2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 418, 419, 420 of the Indian Penal Code, sections 103, 104 of the Trade Mark Act and sections 63, 64 & 65 of the Copy Right Act, 1957.
3. As per prosecution case, the informant along with police raided at the shop of the informant and seized oil of various companies, shampoos and other products which are said to be duplicates.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted vide paras 9 & 13 of the petition that the informant, being

Comp. found the seized materials as duplicate but without any equipment how the petitioner has known about duplicity of the products. The petitioner is said to be present at the place of occurrence, but the informant has not taken the signature of the petitioner on seizure list. The petitioner has got no criminal antecedent and languishing in judicial custody since 7.7.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rahika P.S. Case No. 141 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -IV Madhubani.
