2. The petitioner has preferred this application for grant of regular bail in connection with Harnaut P.S. Case No. 90 of 2024 dated 18.02.2024 registered for the offences punishable u/ss 147, 148, 149, 341, 342, 323, 354, 302, 504, 506 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused persons holding pistol and knife are alleged to have come and caught hold of the informant's husband and the coaccused, Gautam @ Lallu fired on the neck of the informant's

No.59987 of 2025(2) dt.15-11-2025 2/3 husband from behind and the co-accused persons Sonu @ Pasia, Pawan Yadav, Nepali Yadav, Sanjay Yadav and Ashok Yadav also fired on the informant's husband due to which he sustained several injuries in his stomach, backbone, waist and thigh. The co-accused, Karu @ Akhilesh Yadav assaulted below the right armpit of the informant's husband. The co-accused, Kundan Yadav slammed down the informant's daughter after catching hold of her hair. When the informant came to rescue, the petitioner, Subodh Yadav and the co-accused, Vipul Yadav slammed her down due to which she fell down and when the informant's brother-in-law Nitish Kumar tried to save her then the accused persons opened fire on him but Nitish Kumar some how saved his life. Thereafter, the accused persons fled away after opening fire and threatened to kill them.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The other co-accused person has already been granted bail by this court vide order dated 11.12.2024 passed in Cr. Misc. No. 86667/2024. The petitioner has three criminal antecedents as stated in para 3 of the bail
Patna High Court CR. MISC. No.59987 of 2025(2) dt.15-11-2025 3/3 petition. The petitioner is in custody since 23.04.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda at Bihar Sharif in connection with Harnaut P.S. Case No. 90 of 2024, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
