For the Petitioner : Mr. Ganesh Prasad Yadav, Advocate For the Opposite Party : Dr. Kumar Uday Pratap(APP) ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 23-11-2016 Heard learned senior counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Naubatpur P.S. Case No. 346 of 2014 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

It is contended by learned counsel appearing on behalf of the petitioner that it was a case of suicide and, therefore, there is all the probability of false implication of the present petitioner who is the wife of the deceased.

Patna High Court Cr.Misc. No.27885 of 2016 (3) dt.23-11-2016 After perusal of the case diary and the postmortem report, it reveals that the death had not occurred due to hanging rather it was the result of severe beating on the chest, as such, injuries have been found which resulted in his death. In view of such facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. It is accordingly, dismissed.
