The petitioners, namely, Nirmala Devi and Satrughan Das, apprehend their arrest in Roushanganj (Banke Bazar) P.S. Case No. 165/15 registered under Sections 304(B)/34 of the Indian Penal Code.

The informant alleged that his daughter was married with Suranjan Kumar Das, son of Mahadeo Das, in the year 2010. The informant made allegation that the in-laws of his daughter used to torture her and ultimately she was burnt to death. Learned counsel for the petitioners submits that the petitioners are sister-inlaw (Gotni) and unmarried brother-in-law of the deceased. The petitioners have no manner of concern with the family affairs of the deceased and her husband. The deceased was married with Suranjan Kumar Das in the year 2010. She got children. The

Patna High Court Cr.Misc. No.30211 of 2016 (2) dt.09-09-2016 2/2 deceased accidentally caught fire and died during the course of treatment. Ganauri Das, husband of the petitioner no. 1, has already been granted anticipatory bail vide order passed in Cr. Misc. No. 12530/2016. The case of the petitioners stands on the same footing.

Considering the facts that the petitioners are sister-inlaw and unmarried brother-in-law of the deceased and they have stated that they are living separately from the deceased and her husband, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati at Gaya in Raushanganj (Banke Bazar) P.S. Case No. 165/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
