JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2022 The present writ petition has been filed for directing the respondent authorities to remove the encroachment made by the encroachers over the public land in question appertaining to R.S. plot. No. 1747, Khata No. 1031, Thana no. 189, situated at village Panthpakar under Police Station Bathnaha in the District of Sitamarhi.
At the outset, the learned counsel for the petitioner submits that an encroachment proceeding bearing Encroachment Case No. 13 of 2020-21 has already been initiated by the Circle Officer, Bathnaha, District Sitamarhi, i.e. the Respondent No. 4, however, the same is not being taken to its logical conclusion,
Patna High Court CWJC No.20664 of 2021(2) dt.18-08-2022 2/2 hence, a direction be issued to the respondent no.4 to conclude the same expeditiously.
Having regard to the facts and circumstances of the case, the Respondent no.4 is directed to conclude the proceedings of the aforesaid Encroachment case no. 13 of 202021 by passing final order u/s 6(1) of the Bihar State Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of twelve weeks from today, as also take consequential action accordingly.
