2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 302 of the Indian Penal Code .

3 . As per F.I.R., informant namely, Jamun Ray alleged that on 06.09.2019, villagers gave information to the informant that some co-villagers brutally assaulted one person in suspicion of theft of child. On such information , informant

Patna High Court CR. MISC. No.61406 of 2025(4) dt.18-12-2025 2/3 arrived there and found that many persons of the villagers assembled there and they were brutally assaulted the suspected persons and after sometime , he died.

4. It is submitted on behalf of the petitioners that F.I.R. has been registered against unknown . The name of the petitioner surfaced, during course of investigation upon alleged identification by a spy from an alleged viral video of occurrence . No specific overt act is alleged against this petitioner and he is in no way connected with the alleged occurrence . As a matter of fact, the mob have gathered and assaulted the deceased who succumbed to injury. It was suspected that the deceased have come to theft the small child of villagers. Similarly situated co-accused persons has already been granted bail by this Hon'ble Court vide order dated 06.01.2022 in Cr. Misc. No. 32008 of 2021. Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on

No.61406 of 2025(4) dt.18-12-2025 3/3 furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM East Champaran in connection with Pipra P.S. Case No. 310 of 2019, subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
