The petitioner has filed the present writ petition with a prayer to quash Basgit Parcha issued in favour of respondent no. 7 under the provisions of Bihar Privileged Persons Homestead Tenancy Act, 1947.

In this case a counter affidavit has been filed on behalf of respondent no. 2 to 6 and in paragraph no. 7 of the counter affidavit it has been indicated that Collector, Bhagalpur during the

Patna High Court CWJC No.15965 of 2008 (5) dt.24-03-2015 2/2 pendency of the writ petition initiated a proceeding and after hearing the parties has remitted back the matter to the respondent no. 4 i.e. Circle Officer, Sabour, Bhagalpur, with a direction to pass reasoned and speaking order after hearing all the parties. Learned counsel for the petitioner submits that in view of statement made in paragraph no. 7 of the counter affidavit the writ petition may be disposed of with further direction to the Circle Officer to take appropriate step for early disposal of the case in view of the order of the District Collector, Bhagalpur. In view of the facts and circumstances, there is no need to keep the matter pending.

The writ petition stands disposed of.

The Court expects that the Circle Officer/ respondent no. 4 may take appropriate steps for resolving the dispute as early as possible.
