Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. Allegation against the petitioner and three FIR named accused persons along with 5-6 unknown persons is that they abducted the wife of the informant and his two sons. Learned counsel for the petitioner submits that there is delay of one month in instituting the FIR, further the victim has returned and her statement was recorded under Section 164

Patna High Court CR. MISC. No.70493 of 2021(2) dt.28-07-2022 2/2 Cr.P.C. wherein she has not supported the prosecution case even remotely.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jadia P.S. Case No. 179 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
