2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 308(5), 352 and 351(3) of the B.N.S. and Sections 25(1B)(a), 26, 36 and 37(1) of the Arms Act.
3. As per prosecution case, on the alleged date and time of occurrence, this accused petitioner, who was carrying a pistol, came to shop of informant on a motorcycle and demanded a cigarette and when the informant asked for money, he refused to pay, abused the informant and threatened to shoot him. When the informant raised alarm, this accused petitioner fled away from the spot leaving behind his motorcycle and
Patna High Court CR. MISC. No.59737 of 2025(2) dt.03-09-2025 2/2 pistol. Later on, the police recovered the motorcycle and pistol which was left by this petitioner.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from possession of this petitioner.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he came to the shop of informant with a pistol, refused to pay and threatened the informant. It is further alleged that later on, police recovered motorcycle and pistol left by this petitioner. Petitioner has got one criminal antecedent.
6. Considering the facts and circumstances of the case, nature of accusation and criminal antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
