2. The petitioner seeks bail in a case registered for the offence punishable under Sections 409, 406, 420 and 120B of the Indian Penal Code.

3. As per the written report of the informant, the prosecution case in brief is that this petitioner, who is the ExWard Sachiv and co-accused Bharat Barhara embezzled a sum of Rs. 32,11,504/- from the funds of different Yojana listed at Serial No. 1 to 8 in the written report of the informant.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent, has committed no offence and has falsely been implicated in this case due to highhandedness of the

Patna High Court CR. MISC. No.64477 of 2024(2) dt.06-12-2024 2/3 officials that too at the instance of present Mukhiya of the Panchayat. As a matter of fact, all the work of the programmes/schemes mentioned in the F.I.R. have already been completed except the programme mentioned at Serial No. 1 of the F.I.R., which was not completed because some of the Raiyats raised serious objections and did not allow the road to cross through their lands. Petitioner has got no criminal antecedents and he is in custody since 27.06.2024. Moreover, charge-sheet has already been submitted.

On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with other accused person, embezzled huge sum of money.

6. Considering the aforesaid facts and circumstances of the case, rival submissions, nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
