ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 21.07.2019 in connection with Sakra P.S. Case No.353 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were from the dickey of a silver coloured Wagon-R, of which the petitioner was Driver and not from the conscious possession of the petitioner. The petitioner is also not having any criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal
