ANJANA PRAKASH ORAL JUDGMENT Date: 20-04-2015 The Petitioner who is the Informant seeks revision of the order dated 23.04.2012 by which Judicial Magistrate, 1st Class, Jamui has taken cognizance under Sections 323, 341 and 379 IPC even though no offence is made out in Complaint Case No. 136(C) of 2012.

Considering that cognizance is not taken of a particular offence but of the case as a whole, the application is disposed off with direction to the Court below to consider at the appropriate stage as to whether in the facts of the case offence under Section 307 IPC is made out and proceed in accordance with law.

With these observations, the application is disposed off.
