JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-10-2019 The petitioners apprehend their arrest in connection with Kasim Bazar P. S. Case No. 158 of 2019 registered under Sections 147, 148, 149, 225, 307, 323, 337, 338 and 353 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioners is that petitioners along with other accused persons, 23 in numbers, started brick batting upon the police party while they had come to arrest Chhotu Singh and Golu Singh.

Learned counsel appearing on behalf of the petitioners submits that no specific allegation has been levelled against the petitioners and the allegation against them is general and omnibus in nature. He further submits that petitioners are co-villagers and they

No.62036 of 2019(2) dt.17-10-2019 2/2 had assembled only at the place of occurrence when police party had arrived to arrest the aforesaid two persons who were released on bail on the same day and had come to their houses. Learned counsel further submits that similarly situated accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 55917 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that allegatoin against the petitioners is general and omnibus in nature, they are co-villagers and similarly situated accused persons have been granted anticipatory bail, I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kasim Bazar P.S.Case No. 158 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
