JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-09-2019 The petitioner apprehends his arrest in connection with Sono P.S.Case No. 16 of 2006 registered under Sections 25(1b)a, 26 and 35 of the Arms Act and Section 414 of the Indian Penal Code.

Allegation against the petitioner, as per FIR, is that the police during check of vehicles intercepted one motorcycle with two persons riding the same and recovered huge quantity of illegal arms and cartridges. The arrested persons disclosed the name of the petitioner that the said arms and ammunition were being brought from the petitioner and they were going to Deoghar for delivery of the same to one Pawan Singh. Learned counsel for the petitioner submits that arrested co-accused persons have been acquitted in this case on

Patna High Court CR. MISC. No.58339 of 2019(3) dt.24-09-2019 2/2 17.01.2019 by the learned Judicial Magistrate, 1st Class, Jamui. Having regard to the submissions made by the parties and taking into consideration the fact that FIR was lodged in the year 2006 and the case of the petitioner was separated on 05.04.2006 and the process under Section 82 Cr.P.C. has been issued by the learned court below, accordingly, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is hereby rejected. (Anil Kumar Sinha, J) sujit/- U T
