Mr.Rabindra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-02-2023 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The petitioner is in custody in a case registered for offences punishable under Sections 302, 365, 201 and 120B/34 of the Indian Penal Code.

It is submitted by the counsel for the petitioner that it is a case abduction of the minor boy of the informant thereafter the murder of the boy has been committed by the accused persons. It is submitted that the petitioner has falsely been implicated in this case and the name of the petitioner has not been named in the first information report. During investigation one Kajal Devi apprehended and confessed the guilt in respect of commission of the murder of the victim. Allegation against the petitioner is that the mobile of the petitioner was used in this case. There is no consistent material evidence against the

Patna High Court CR. MISC. No.59132 of 2022(3) dt.27-02-2023 2/2 petitioner and there is no eye witness also. The petitioner is in custody since 21.05.2022 having no criminal antecedent. The learned Additional Public Prosecutor for the State opposed the prayer for bail.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Chausa P.S. Case No. 177 of 2019 to the satisfaction of the Subdivisional Judicial Magistrate, Udakishunganj, Madhepura.
