JUSTICE SHAILENDRA SINGH ORAL ORDER 29-08-2025 Petitioners seek regular bail in connection with Barauli P.S. Case No. 219 of 2016 dated 12.11.2016 registered for the offence punishable under Section 304(B) read with Section 34 of IPC.
2. Heard Mr. Rajat Kumar Tiwary, learned counsel for the petitioners, Mrs. Gulnar Begum, learned APP for the State and also, perused the FIR as well as the trial court's order.
3. In the facts and circumstances of this case, and mainly considering the petitioners' pleas that the trial of the principal accused, namely Santosh Mahto (husband of the deceased), Raj Kumar Mahto (devar of the deceased), and Sanju Devi (devrani of the deceased), has ended in their acquittal, and the material witnesses who are to be examined in the trial of the
Patna High Court CR. MISC. No.59470 of 2025(2) dt.29-08-2025 2/2 petitioner also went hostile, whose deposition's copies have been filed with this petition, and also coupled with the fact that both the petitioners are said to be sisters-in-law of the deceased, and taking into account their custody period and completion of investigation against them, this Court is inclined to release them on bail. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Barauli P.S. Case No. 219 of 2016. (Shailendra Singh, J) maynaz/- U T
