Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Bhojpur Mahila P.S. Case no. 78 of 2019, registered under Sections 341, 323 and 498(A) of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner and O.P. No.2 submits that, at present, both are living together and leading
Patna High Court CR. MISC. No.55739 of 2019(5) dt.13-12-2019 2/2 their conjugal life, peacefully, in the house of petitioner (husband) and both have no grievance to each other. Therefore, for better relation in between the petitioner and O.P. No.2, the petitioner may be allowed privilege of pre-arrest bail. Having regard to the facts and circumstances of the case, since, the petitioner and O.P. No.2, who are husband and wife, have no grievance to each other and they are leading their conjugal life, peacefully, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Ara in connection with Bhojpur Mahila P.S. Case No. 78 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
