The petitioner apprehends her arrest in a case registered under Sections 363, 375, 120(B)/34 of the Indian Penal Code.

The informant alleged that the petitioner took his daughter Beauty Kumari to Tharthari Bazar but she did not return. The informant alleged that the accused persons kidnapped his daughter.

Learned counsel for the petitioner submits that Beauty Kumari returned and made her statements under Section 164 Cr.P.C. She disclosed that she herself went to Biharsharif and stayed at the house of the maternal-uncle and aunt of the informant. Her parents lodged a case. The victim did not even name the petitioner.

No.34202 of 2014 (2) dt.11-02-2015 2/2 Considering the fact that the victim denied her kidnapping, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar Jha, Judicial Magistrate, 1st Class, Hilsa, Nalanda in Tharthari P.S. Case No. 43/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
