08-07-2015 Heard Sri Anish Chandra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The present petition has been filed with a prayer to restore Cr. Misc. No. 26282 of 2011, which stood dismissed on 03-04-2014, due to non-prosecution. Prior to order dated 03-04-2014, earlier also the petition was dismissed on 19-09-2013, due to non-prosecution, however; subsequently the case was got restored.

Learned counsel for the petitioner tried to persuade the Court that due to bona fide reason, on the last date, none appeared on behalf of petitioner when the case was called out. Besides hearing the parties, I have also perused the ground set- forth in the petition. The ground set-forth in the petition is not sufficient to persuade the Court to pass any positive order.
