JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 11-02-2015 The petitioner apprehends his arrest in connection with Complaint Case No.C 26 of 2012 registered under sections 27(a), 27(b)(ii) and 27(d) of the Drugs and Cosmetics Act.

It is alleged that some drugs were found in the room which has been let out to the tenant.

Learned counsel for the petitioner submits that for the same offence earlier a case was instituted being Muzaffarpur Town P.S. Case No.485 of 2009 in which he was arrested and subsequently released. He submits that for the same alleged occurrence, the instant complaint case has been filed. Considering the facts and circumstances of the case, the petitioner Bharat Prasad Singh is directed to be released on anticipatory bail, in the event of his arrest/surrender, in connection with Complaint Case No. C26/2012 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Shri Sanjay Kumar Singh, Judicial Magistrate Ist Class, Muzaffarpur.
