JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 152, 323, 342, 338, 427, 435, 353, 379 and 307 of the Indian Penal Code. It is alleged that when a bus crushed a person then this petitioner being the Panchayat Mukhiya laid a mob and put the bus on fire and when the police went to pacify the mob then stones were pelted as a result S.D.P.O. and other police personal received injuries.
It is submitted by learned counsel for the petitioner that the mob was protesting against accident when the police personal called the petitioner to pacify the mob but when he went to the place of occurrence to pacify the mob then he was also assaulted as a result he received hair line fracture injury on the hand. Hence,
Patna High Court Cr.Misc. No.23059 of 2015 (2) dt.20-07-2015 2/2 the case was lodged by the police personnel in order to save their skin from Muffasil P.S. Case No. 81 of 2015 lodged by the family members of the victim who was crushed by the bus. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Muffasil P.S. Case No. 82 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
