The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 181/2019, registered for the offence punishable under Sections 323, 307, 376, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of taken the informant to Delhi and raped her on the protest to the whom they were coming by train, pushed the victim girl from the train at Buxar station.

Learned counsel for the petitioner submits that the petitioner was love affair with the victim and she had gone to Delhi by consent and the petitioner is in custody since 15.06.2019. There is delay in lodging in FIR.

Heard both the parties and perused the records, there is directed allegation against the petitioner. The allegation is in serious nature not only privacy of a woman has been breached and she was left on her own after she was thrown out at Buxar station. She was provided medical treatment by GRP, Buxar and later on referred to P.M.C.H.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
