JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 310 of 2019, registered for offences punishable under Sections 412 of the Indian Penal Code and later on added Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegation is of recovery of loaded country made pistol and a cash of Rs. 5,000/- from the possession of the petitioner and apart from that he is accused in four other cases.. It has been submitted on behalf of the petitioner that so far other case is concerned, he has been acquitted in three cases and so far this case is concerned, nothing has been recovered from him and he has falsely been implicated and he has been in judicial custody since 21.04.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.58038 of 2019(4) dt.03-03-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Saran at Chapra, in connection with Sonepur P.S. Case No. 310 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below as well as subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of nine months so that the police may watch his activities during that period and during that period, if petitioner's involvement is found in any other serious case, prosecution will be at liberty to move for cancellation of his bail bonds.

Let a copy of this order be communicated to the Superintendent of Police, Saran for needful.
