The petitioner seeks bail in a case under Section 363(A), 364 and other sections of the Indian Penal Code. The petitioner is not named in the FIR. The name of the petitioner figured in the case in the confessional statement of co-accused. Youngest son of the informant was kidnapped. It appears that the victim boy was recovered from Begusarai railway station with an accused but that accused managed to flee away from the custody of police. The petitioner was apprehended but he was not put on T. I. parade. The victim as well as the informant made their statement under section 164 of the Cr. P. C. but they did not disclose the name of the petitioner. The petitioner is in jail

Patna High Court Cr.Misc. No.23551 of 2015 (3) dt.22-09-2015 2/2 since 11.01.2015.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari (East Champaran) in Madhuban P.S. Case No. 04 of 2015.
