ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.07.2019 in connection with Rail Jhajha (G.R.P.) P.S. Case No.110 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the alleged recoveries of liquor were made from the compartment of the train in which many other co-passengers were travelling and not from the conscious possession of the petitioner. It is further submitted that the petitioner is involved in one case under Section 307 of the Indian Penal Code, in which he is on bail.

Considering the aforementioned facts and
