The petitioner has approached this Court for the following reliefs:- (i) To direct the respondent authority to consider the case of the petitioner for appointment on compassionate ground, his father died in harness on 05.05.2021, leaving behind the petitioner and family members, while the petitioner's father working as Assistant Teacher, Sri Anugrah Singh, Plus-2 High School, Sagahi, Gaya.

Patna High Court CWJC No.14374 of 2024(3) dt.27-01-2025 2/3 (ii) For that death of his father that the petitioner has submitted an application before the respondent's authority for appointment of compassionate ground and same was the respondents Head Master of the School sent the application form before the District Program Officer (Establishment), Gaya on 10.11.2022 i.e. Annexure-P/2.

A counter affidavit has been filed on behalf of the respondent no.3. The respondent no.3 has stated in para-7 of the counter affidavit that since after 2022, vacancy for appointment on compassionate ground was not made available from the Department. Now, recently vide letter no.2336 dated 23.09.2024, the vacancy for appointment has been received and the same is under process of roster clearance. As soon as the roster clearance is received in the office of the respondent, the name of the petitioner would be sent to the District Education Compassionate Committee for its final consideration which is likely to be completed within next three months. 4.

Considering the submission made in para- 7 of the counter affidavit filed on behalf of the respondent no.3, I direct the respondent authority to send the name of the petitioner for the appointment on compassionate ground to the District Education Compassionate Committee, within a period of three
