JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 03-05-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

From the arguments advanced by the parties, it appears that the petitioner has not filed petition for exemption and as such his case was not considered on the line of the case of Ashish Khandewal. The only issue which led to two different standard followed by the University is the fact that the application for grant of exemption and non-submission of application for grant of exemption. In view of the above, the Court grants liberty to the petitioner to file petition for exemption within a period of one month from today and the University is well advised to consider the case of the petitioner if the

Patna High Court CWJC No.11712 of 2016 dt.03-05-2018 2/2 only objection of the University as indicated during the course of hearing is non-submission of application for exemption. The University is expected to consider the case of the petitioner on the line of Ashish Khandewal, if application is filed on behalf of this petitioner for exemption within time frame indicated hereinabove. Entire exercise in this regard shall be taken by the respondent university within a period of 60 days from the date of receipt of application for exemption along with a copy of this order. With the aforesaid, this writ application is disposed of accordingly.
