Having regard to the nature of allegation for offence under sections 341, 323, 324, 307, 448, 504/34 of the Indian Penal Code and the fact that such case was lodged against the petitioner in the month of June, 2011 wherein he was a named accused, this Court would not be inclined to grant privilege of anticipatory bail to the petitioner only because after two years the police did not submit the charge sheet against the petitioner for offence under section 307 of the Indian Penal Code. The petitioner, therefore, must surrender and if he does so the court below shall consider the prayer for regular bail of the petitioner by taking into account the allegation that was made against him in the First Information Report and the resultant injury which has been found by the Doctor in the injury report.
