JUSTICE RAVI RANJAN ORAL ORDER 30-08-2016 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 341, 323, 325, 307, 354, 379 and 504/34 of the Indian Penal Code.
It is contended that the allegation upon the petitioner, who is a lady, is ornamental in nature of removing Rs. 500/- and a cell phone. So far the petitioner no. 2 is concerned, it is contended that the allegation is general and omnibus and, at best, it can be said that the allegation of assault is upon accused Amit Jha and Bhola Mishra. It is further contended that the main accused Amit Jha has already been granted regular bail.
Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Manorma Devi @ Manor
Patna High Court Cr.Misc. No.29580 of 2016 (2) dt.30-08-2016 Devi and Bhagwan Jha, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Arer Police Station Case No. 56 of 2014 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Madhubani, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
