The petitioner apprehends his arrest in connection with Sajour (Shahkund) P.S. Case no. 48 of 2015, registered under Sections 147, 148, 149, 323, 324, 307, 504 and 506 of the Indian Penal Code.

The accusation is that five persons named in the F.I.R., including the petitioner, variously armed with weapons entered in the house of informant Sushil Mandal and petitioner Sanjay Mandal gave rod blow at his head and Shiv Mandal caused injury through lathi, Subhash Mandal gave iron rod blow causing injury at right hand finger of Sushil, brother of informant, and Manoj Mandal also caused injury to brother of informant.

Patna High Court CR. MISC. No.63769 of 2019(3) dt.22-10-2019 2/2 Learned counsel for the petitioner submits that occurrence of Marpit took place due to land dispute. Moreover, injuries as found on the person of informant, which is attributed against the petitioner, are simple of nature. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Sajour (Shahkund) P.S. Case No. 48 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
