2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 323, 324, 354(B), 307, 447, 448, 379, 504, 506 of the Indian Penal Code.
3. As per prosecution case, the accused persons including the petitioner entered in the house of the informant and started assaulting and abusing the informant and his family members. In course of incident, the petitioner is said to have assaulted Leela Devi by means of lathi.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Both the parties are agnates and the petitioner has falsely been implicated
Patna High Court CR. MISC. No.61477 of 2023(2) dt.22-09-2023 2/2 in this case due to village politics. There is case and counter case between the parties. The petitioner is said to have assaulted Leela Devi but the injury report of the Leela Devi vide Annexure-2 series, shows her nature of injury is simple caused by hard & blunt substance. The petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 15.7.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Forbesganj P.S. Case No. 530 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria.
