The petitioner apprehends her arrest in Mashrakh P.S. Case No. 114 of 2014, registered for the offences punishable under Section 7 of the Essential Commodities Act. The S.D.O., Block Supply Officer raided the godown of Jairam Singh and recovered 25 packets each containing 50 kgs of rice and 23 packets each containing 50 kgs of foodgrains. Learned counsel for the petitioner submits that the petitioner is the brother of Jairam Singh and nothing has been recovered from the possession of the petitioner. Jairam Singh has already been enlarged on bail.
Considering the facts aforesaid and the fact that the police raided the godown of Jairam Singh and the petitioner is
Patna High Court Cr.Misc. No.34231 of 2014 (2) dt.12-02-2015 2/2 brother of Jairam Singh, he, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Chaudhary, the learned Judicial Magistrate, Chapra in connection with Mashrakh P.S. Case No. 114 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
