The petitioner seeks bail in Mirganj P.S. Case No. 95 of 2019, registered for the offence punishable under Sections 419, 420 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner was allotted the work to the tune of Rs. 6,49,500/-, but he did not complete the work and misappropriated huge government money.

It is submitted on behalf of the petitioner that petitioner is Ward Member of Rangpura Uttar Gram Panchayat and he has completed 80% of work, out of the allotted work. The petitioner had spent Rs. 4,40,000/- on the said work and he received payment only of Rs. 3,89,700/- and thus, no money has

Patna High Court CR. MISC. No.70766 of 2021(3) dt.25-04-2022 2/2 been misappropriated by him. Last installment of the sanctioned amount of Rs. 2,59,800/- has not been released as yet. Petitioner claims clean antecedent and he is in custody since 27.10.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Purnea in connection with Mirganj P.S. Case No. 95 of 2019.
