The petitioner seeks bail in Salimpur P.S. Case No. 286 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, petitioner is alleged to have caused gunshot injury in the abdomen of cousin brother of informant namely, Munna Yadav.

It is submitted on behalf of the petitioner that alleged occurrence took place on account of making construction of house on a disputed land in which both sides sustained injury and there is case and counter case. Petitioner claims clean antecedent and he is in custody since 20.10.2020 and thus, remained in custody for more than one and half years.

No.70554 of 2021(3) dt.25-04-2022 2/2 Considering the backdrop in which the alleged occurrence took place and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Barh, Patna in connection with Salimpur P.S. Case No. 286 of 2020.
