The petitioner apprehend his arrest in a case registered for the offence punishable under sections 03 of Railway Property (U.P.) Act.

Allegedly, 16 bags printed as SFC Bihar State Food and Civil Supplies Corporation Limited of rice each measuring 50 kg is said to have been recovered near railway track. The apprehended persons disclosed the name of the petitoner It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to suspicion. No such occurrence, in the manner as alleged, has ever taken place.

His name transpired in the present case on the basis of confessional statement of the apprehended persons. No witnesses have supported the allegation against the petitioner. Petitioner has no criminal antecedent, which is also mentioned in para-3 of the bail application.

Learned APP for the State opposed the prayer for anticipatory bail and submits that the petitioner is also involved in the present case.

Having regard to the facts and circumstances of the case, since the petitioner is involved in the black marketing of government supplies, I am not inclined to grant bail to the petitioner. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly, dismissed.
