JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is said to have fired upon the informant with rifle.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no dispute between the parties and no motive for offence is disclosed by the informant. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.58774 of 2022(2) dt.03-01-2023 2/2 the informant oppose the prayer for bail and submit that there is specific allegation against the petitioner to fire upon the informant with rifle.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Charpokhari P.S. Case No. 103 of 2022.
