JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-02-2023 This criminal revision application has been filed against order dated 14.11.2016 passed by learned Sessions Judge, Kaimur at Bhabua in Cr.Appeal No.28 of 2016 by which he has deducted the maintenance amount by modifying order dated 2.6.2016, passed by the Sub Divisional Judicial Magistrate, Kaimur at Bhabua in Domestic Violation Complaint case no. 1486 of 2015.
It is submitted by learned counsel for the petitioner that without appreciating the facts and materials available on the record in true perspective, learned Sessions Judge has passed the impugned order.
I have carefully perused the impugned order. It
Patna High Court CR. REV. No.177 of 2017(2) dt.22-02-2023 2/2 appears that while reducing the quantum of maintenance amount, the learned Sessions Judge has considered the fact that opposite party no.2 is an old person and resides in the house of other person and has liability of his parents and as such the reduced quantum of maintenance cannot be said to be on lower side. I do not find any illegality or irregularity in the impugned order, which requires any interference by this Court. Accordingly, this criminal revision application stands dismissed.
