JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other allied sections of the Indian Penal Code.
As per the prosecution case, informant suspected that her husband has been killed by the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion and prior enmity. There is no eye witness of the occurrence. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 15.7.2020.
Learned counsel for the State and the informant
Patna High Court CR. MISC. No.70768 of 2021(3) dt.26-04-2022 2/2 oppose the prayer for bail. They submit that during investigation specific evidence has been collected that petitioner had illicit relation with a lady named Sagira Khatoon and they were seen in the compromising position by the husband of the deceased. Thereafter he had been forbidden by the petitioner not to disclose the matter but he disclosed the same by which petitioner became infuriated and committed his murder and also beheaded the dead body. Co-accused Sagira Khatoon has also made confession to this effect during course of investigation. Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
