2.The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 379, 120B of the Indian Penal Code and Section 66(C) and (D) of the I.T. Act.

3. As per prosecution case, police arrested three accused persons and from their possession, one mobile, some xerox copy of non judicial stamp of Rs. 100, loan approval letter and some other documents along with bank passbook have been recovered. On query for the same, they disclosed that they were cheating the customers for providing loan.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

He was not apprehended on spot by the police and also he has no concern with the said offence. No any incriminating article has been recovered from the conscious possession of the petitioner. Nobody has made any complaint against him in respect of cheating. Moreover, he is languishing in judicial custody since 18.04.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Giriyak (Pawapuri) P.S. Case No. 619 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
