JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 400, 402 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act. No doubt, the petitioner does have criminal antecedent of several cases but in the present case, neither he was caught on the spot nor anything was recovered from his conscious possession. The name of the petitioner, in the present case, came in the statement made by co-accused, who is said to have been caught on the spot.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.30482 of 2016 (2) dt.05-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Sikrahata P.S. Case No. 53 of 2015.
