JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 The petitioners are apprehending their arrest in connection with Dariyapur P.S. Case No. 64 of 2016, registered for offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code and Sections 420, 120(B) and 201 of the Indian Penal Code.
Allegation against the petitioners that they have not submitted the file/folders with regard to merit list of the teachers for the year 2006-07.
It has been submitted on behalf of the petitioners that they are Panchayat Secretary and were not posted in the concerned
Patna High Court Cr.Misc. No.14199 of 2018 (2) dt.11-04-2018 2/2 block during the aforesaid period as they joined as Panchayat Secretaries in the year 2012-13, however, the petitioners have already deposited required documents in the office of informant. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioners to surrender before the court below within a period of four weeks and on their surrender, the court below shall grant them the privilege of provisional anticipatory bail to his own satisfaction till submission of chargesheet and if the charge-sheet is submitted against the petitioners, they shall surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available of record at that time.
