The petitioner apprehends his arrest in a case registered under Section 376 and other sections of the IPC. The informant has alleged that the petitioner, after marrying her, kept her at different places, made physical relationship and when she became pregnant, he pressurized her for abortion. The petitioner, after abortion and again conceiving, tried much to abort the child and in this way, he cheated and left the informant at her parent's home and fled away. It has been submitted on behalf of the petitioner that as per the prosecution, it is reported that the petitioner and the informant had developed physical relationship since 2008 but the present case was instituted in the year 2014. It is further submitted that the matter was taken up by the State Women Commission and on the basis of the complaint made by the informant, the said complaint, after due inquiry, was rejected by the State Women Commission. It is further submitted that the petitioner had no such relationship as alleged.

Considering the aforesaid fact that a complaint petition filed before the State Women Commission has already been rejected, the petitioner, named above, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.Case No.188 of 2014, subject to conditions as laid down under section 438(2) of the Cr.P.C.
