The petitioner seeks bail in a case registered for the offences punishable under Sections 328 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.04.2021, charge-sheet has been submitted in the case, he has antecedent of five cases and the informant alleges that his vehicle was looted by an unknown criminal by making him unconscious by drugging him. Learned counsel for the petitioner submits that the FIR was against unknown and the vehicle which is alleged to have been looted was found in an abandoned condition and the petitioner came to be arrested in the present occurrence based on

Learned counsel further submits that if the petitioner had any intention of committing the occurrence then definitely he would not have called the informant from his own mobile number and thus create evidence against himself. It is further submitted that the petitioner has not been put on TIP.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.04.2021, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hajipur Sadar P.S. Case No. 415 of 2021 with a condition that one of the bailors of the petitioner shall be his mother Rajvanshi Devi. (Satyavrat Verma, J) Rishi/- U T
