Public Prosecutor for the State and also heard learned counsel for the informant.

Petitioner apprehends his arrest in connection with Charpokhri P. S. case no. 108/2015 registered under sections 406, 409 and 420 of the Indian Penal Code as well as section 7 of the Essential Commodities Act.

Petitioner happens to be mill owner and accusation against him is that he did not supply rice though he had already taken paddy from the Bihar State Food & Civil Supplies Corporation Limited. The contention on behalf of the petitioner is that several cases have been instituted against different persons and this court as well as coordinate benches of this court have granted privilege of

Patna High Court Cr.Misc. No.24620 of 2015 (2) dt.10-07-2015 anticipatory bail to different persons taking note of terms of agreement executed between the parties.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Ara in Charpokhri P. S. case no. 108/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
